Collier County Survivors Receive $5.6 Million Settlement in a Motor Vehicle Death Case
August 24, 2012 | Category: Automobile Accidents | ShareA Collier County, Florida driver ran out of gas on southbound I-75 in Naples, FL. After pulling to the side of the road, she called her husband who arrived at her location, pulled behind her and stopped. At the same time the Defendant was driving his employers' pick-up truck pulling a trailer. The trailer became loose because the driver had used the wrong size ball on the truck. The safety chains, which had not been properly secured to the frame of the trailer by the manufacturer, immediately snapped causing the trailer to strike the guardrail and rear-end the husband's vehicle. The impact from the trailer pierced his gas tank and buckled his doors so he couldn't get out. Although not injured in the initial impact, the piercing of the gas tank caused a fire from which the husband could not escape because of the buckled doors. The husband died in the fire.

Mr. Spivey successfully obtained a $5.6 million settlement for the family.
