A Fort Myers drunk driving attorney at Spivey Law Firm, Personal Injury Attorneys, P.A. said that on October 22, 2020, Mothers Against Drunk Driving (MADD) marked the 20^th anniversary of the 0.08 blood alcohol content (BAC) standard in the United States. MADD says this was a historic victory for victims of drunk driving that saved thousands of lives.

President Bill Clinton signed the bill in the White House Oval Office with MADD National President Millie Webb, whose family was devastated by an 0.08 BAC drunk driver, and some other drunk-driving victims present.

In a MADD press release, Ms. Webb said, “When my family was hit by a 0.08 BAC driver, killing my 4-year-old daughter Lori and my 19-month-old nephew Mitch, and injuring me, my husband Roy, and my unborn child Kara, it was not considered a crime.”

MADD’s current National President Helen Witty said, “ I am humbled every day by the incredible change effected by so many victims of this violent, preventable crime. MADD’s history of putting a name and face to the victims of drunk driving is more important than ever as we work to eliminate drunk driving once and for all.”

Forty-nine of the 50 states and the District of Columbia have the legal limit for driving under the influence of alcohol at 0.08. The legal limit in Utah is 0.05.

BAC measures the amount of alcohol circulating in the bloodstream. It is expressed in terms of weight (milligrams) per unit of volume (milliliters) and is usually shown as a percentage. BAC is used for legal and medical purposes to indicate a person’s level of intoxication, according to Verywell Mind.

The occurrence of drunk-driving accidents decreases when drivers do not drink and drive. The National Highway Traffic Safety Administration (NHTSA) reports there are many factors that determine blood alcohol content and the level of impairment a person may experience. Individuals may experience a variance due to weight, body fat percentage, hydration, digestion, and how alcohol affects the body’s chemistry. The alcohol content of the consumed drinks and the amount of time passing since drinks are consumed all influence BAC. Medications both prescribed and over-the-counter can also affect impairment.
