The design of an ATV, along with its intended use, makes it particularly vulnerable to rollover accidents.  Further, a rollover accident with an ATV, without the protective shield of the outer structural “cage” of a standard motor vehicle, could give the rider severe injuries.

Lack of Protective Systems

As a general rule, ATVs lack the protective systems typical of other vehicles operating at such a high speed. There are no airbags or over-the-shoulder seatbelts on most ATVs, which can expose riders to a significant risk of injury.

Though some recreational companies offer helmets for use, others may not provide them to riders, which can further exacerbate the problem.  Should a rider be thrown from the vehicle without a helmet, they could suffer a severe brain injury.

Multi-Rider Fit

Most ATVs were not built to support more than a single rider.  The balance of an ATV could be thrown off by the presence of two or more riders, which contributes to the risk of an accident.

Young Riders

Recreational ATV use is common among young adults who may not have a license to operate a standard motor vehicle and are quite poorly prepared to handle the ATV in a safe manner. If the recreational company allows youth riders to operate their ATVs without adequate training (and without proper supervision), then it could potentially give injured plaintiffs an opportunity to bring a lawsuit on that basis.
