Victim of Crash Speaks About Installation of New Traffic Light
"Very pleased. I wish it (the traffic light at the intersection of Metro Parkway Extension and Briarcliff Road) had been there a year ago, but it's good. It will be a much safer intersection. But it needs to have a light, and I'm glad there's one there," said accident victim, David Vanaman.
Less than 24 hours after the opening of the new Fort Myers Metro Parkway Extension, David Vanaman was in a medically induced coma with brain damage, skull and shoulder fractures and injuries to the entire left side of his body following a crash when an SUV which was heading east on Briarcliff Road pulled into the middle of the intersection into the path of Mr. Vanaman's scooter.
As crews are finally installing a traffic light at this dangerous intersection, attorney for the Vanaman family, Randall Spivey of Spivey Law Firm, Personal Injury Attorneys, P.A. says, "This is what we fought for. Unfortunately it took an accident to draw proper attention to the dangers of this intersection, but my thought all along was they prematurely opened the intersection."
In October, 2012 Attorney Spivey, who made it his mission to have a traffic light installed at the Metro Parkway Extension and Briarcliff Road intersection said, "There should have been a safe and effective Maintenance of Traffic Plan for this type of project. A safe and effective Maintenance of Traffic Plan is critical for the safety of motorists using the roadway. Each phase of this construction should have a proper Maintenance of Traffic Plan, and the Plan should have accounted for temporary traffic lights at a minimum. When the road was opened, there were numerous obstructions that blocked motorists' views of on-coming traffic. These obstructions included improper barricade placement, improper placement of signs, construction vehicles parked in the roadway, and other hazards. These obstructions created a trap for motorists. This situation created by the construction was especially hazardous to motorists because they opened the roadway with no traffic light. "
Mr. Vanaman, when commenting on his current condition, said, "I feel like I aged about 30 years. I don't drive any more, and it's hard to focus on things. I still have a long way to go. I don't walk very well, I walk with a cane."
