Defective Medical Devices Product Liability Claims

March 3, 2014 | Category: Defective Products, Medical Devices | Share

Each year many Americans are injured and or killed as a result of defective products, according to the he U.S. Consumer Product Safety Commission (CPSC).

Millions of Americans depend on advanced medical devices to correct health issues that  impede their daily life. While most benefit from these devices, some patients suffer injuries as a result of faulty medical products.

A growing number of patients experience severe complications with devices such as hip replacements, knee replacements and transvaginal mesh. Simply seeking a better quality of life, patients often are unaware of the risks of these procedures; risks which may far outweigh any of the device’s potential benefits.

A  defective medical device can cause life-threatening physical injuries and trauma that can include financial damage. Injured victims must deal with large and unforeseeable medical expenses, loss of wages, pain, suffering and loss of quality of life. Family members also may suffer economic loss, mental anguish and loss of companionship in caring for an injured family member.

Manufacturers have a responsibility to ensure that their products are safe and inform the public of any potential hazards their products may cause.

"When a consumer suffers an injury or wrongful death after using a defective medical product, they may be entitled to seek compensation from the manufacturer, distributor, or retailer through a product liability claim," says Attorney Randall Spivey of Spivey Law Firm, Personal Injury Attorneys, P.A.

A consumer can seek a product liability claim due to:

  • Defects in a product’s design which result in a failure in the way the product operates.
  • Manufacturing flaws as a result of poor workmanship or poor-quality materials used during the construction or assembly of the product which result in a product failure.
  • Failure to warn consumers either through improper labeling, inappropriate instructions, lack of warnings about a product’s possible dangers.
