Liability in Florida Rollover Crashes
August 3, 2023 | Category: Vehicle Rollovers | ShareOn Friday, June 14, 2023, all lanes of the Florida Turnpike near the Boynton Beach Boulevard exit in Palm Beach County were closed because of the heavy damage from a rollover crash involving four vehicles. The crash occurred around 6:30 a.m. in the southbound lanes.
CBS12 News reported that emergency vehicles were forced to weave through the heavy, standstill traffic to find the four-vehicle crash. One accident victim was flown to the hospital by a Special Operations Unit, and three others were taken to nearby hospitals by first responders.
Increase in Rollover Crashes
Since SUVs have become popular, there has been an increase in rollover crash fatalities. However, changes to SUVs, such as more stringent roof crush standards, electronic stability control (ESC) and more stable SUV designs have resulted in improvements.
Common Causes of Rollover Accidents
There are several common causes for rollover accidents, including:
- Impaired driving – Experts say that 30 percent of all rollover crashes involve impaired drivers. Being impaired by alcohol and/or drugs reduces the skills needed for safely operating a vehicle.
- Speeding – Speeding greatly increases the chances of a rollover accident. A study by the Federal Motor Carrier Safety Administration (FMCSA) found that as many as 45 percent of rollover accidents involved high speeds. Rollover accidents are especially likely when drivers round curves at high rates of speed.
- Lack of vehicle maintenance by owner – Accidents may be caused by a failed automotive part or component because of a lack of maintenance. Vehicles need to have regular maintenance performed to prevent future accidents.
- Improper cargo loading – Cargo may shift when driving which can cause a driver to compensate for the weight shift and possibly cause a rollover accident.
Rollover Accident Liability
Liability is determined by reviewing police reports, driver accounts, witness accounts, and other information that is collected about the rollover accident. Drivers and third parties may be liable for rollover accidents. If it’s a third party, they may have caused the accident because of:
- Vehicle defects
- Faulty vehicle maintenance
- Road hazards and debris
- Improper cargo loading
Third parties may include employers of commercial drivers, repair shops, vehicle manufacturers, store employees loading cargo, and those responsible for maintaining hazard-free roadways.
