Five months ago in October 2012, David Vanaman became the first victim of a crash at the intersection of Briarcliff Road and the newly opened Metro Parkway Extension in Ft. Myers, FL. He is still recovering from a severe head injury. The engineering investigator for the Spivey Law Firm, Personal Injury Attorneys, P.A. discovered that the driver's view was obstructed by numerous signs and barricades that should have been removed before the road was opened.
The Vanaman family attorney, Randall Spivey said, "The bottom line is, the roadway should not have been opened with those obstructions."
"I don't want anyone else to have to go through this." said David Vanaman as he and his wife, Christine, filed a negligence lawsuit against the two companies in charge of the construction project charging them with negligent planning and supervision of the construction project which created a highly dangerous but easily preventable trap for motorists.
Christine said, "It is shocking to see the pictures and find out that someone really didn't do their job."
Following the accident the Florida Department of Transportation conducted a study of the intersection. The result of this study led to a decision to install a stop light at this dangerous intersection which is scheduled to be installed in the fall of this year.
