Pedestrian Alert - April 5th is National Walking Day

April 3, 2023 | Category: Pedestrian Accidents | Share

National Walking Day is commemorated every year on the first Wednesday of April. It is sponsored by the American Heart Association to encourage Americans to “get their hearts pumping.” According to a recent poll of 2,002 adults, 54 percent said walking was their preferred mode of transportation whenever possible.

2023 National Walking Day April 5National Walking Day, with its organized walking events, it is estimated that more pedestrians will be on our sidewalks and crossing our streets than on other days. With this increase, comes the possibility of more pedestrian accidents.

Accidents involving motorists and pedestrians are a serious problem in the United States. In 2020, an estimated 104,000 pedestrians received non-fatal crash-related injuries, for which they sought emergency department assistance. 7,000 pedestrians were tragically killed in U.S. accidents.

Speeding, impaired driving, and distractions are linked to thousands of pedestrian-motor vehicle accidents each year.

There are also environmental factors that may fail to adequately ensure the separation of pedestrians and motor vehicles. Crosswalks may be non-existent or unsafe. Crossing devices may not be working correctly, or poorly timed, encouraging pedestrians to cross when it is unsafe to do so. Roads may also be overly narrow. There may not be any sidewalks at all.

Importance of Seeking Medical Attention

It is important to act quickly in seeking medical attention after an accident. Proper and prompt attention could greatly reduce the severity of injuries and prevent them from worsening. Also, Florida has a 14-day rule for personal injury protection.  Florida’s 14-day rule is covered in Statute 627. 736. It states that personal injury accident victims have 14 days to seek medical attention if they want to claim personal injury protection benefits. Liability in Pedestrian-Vehicle Accidents

In determining liability for pedestrian accidents, driver error, including speeding, impaired driving, distractions, vehicle malfunction, poor road design, crosswalk problems, crossing device malfunctions, and more, all play a role in determining liability. There may be more than one entity that could be liable for a pedestrian’s injuries, and/or tragic death.

Here is what one of the firm’s clients had to say about Spivey Law Firm, Personal Injury Attorneys, P.A.

I was unfortunately injured in a car accident that was not my fault. The insurance companies were very uncaring and treated me like I had somehow done something wrong. My health insurance would cover nothing related to the accident. I contacted Mr. Spivey and he and Mary took over. I received the medical care I needed, and Mr. Spivey handled the insurance companies. In my 60 years, I have never needed to contact a personal injury lawyer and never thought I would. I was totally turned off by the high-pressure ads on TV by a different company. However, Mr. Spivey and Mary proved that not all personal injury attorneys are the same, and if you want compassionate and professional assistance, choose a professional attorney. The settlement was extremely generous, and the process was handled professionally and seamlessly.
