Slips and Falls Can Hurt Anyone!
September 4, 2013 | Category: Slip and Fall Accidents | ShareThe World Health Organization (WHO) says that falls are the second leading cause of accidental or unintentional deaths worldwide. The Naples Daily News, in an article titled "Falls Can Hurt or Kill Anyone, Any Age", reported on July 30, 2013, that in the United States injuries are the leading cause of death for people ages 1 to 44 and accidental trips, and falls are a larger portion of this number than one would think. Although one out of three adults older than 65 falls each year, falls are not discriminatory. In Collier County last year 130 people had "fall" listed as their cause of death, of these 130 was a 12-year-old boy who died after falling down stairs at home.
Not all slip and fall accidents occur in one's home, however. Many occur elsewhere. In fact, in 2012 Wal-Mart lost a $1.5 million slip and fall case when they were found 80% responsible for the fall of a Florida woman.
According to Florida law, apartments, condominiums, office buildings, shopping centers, stores, homes, parking lots and governmental buildings are required to provide safe properties for visitors and employees. Negligence may be attributed to the owner of the property, property manager, landlord and/or any third party whose responsibility it is to maintain and provide a safe premises.
"We have seen countless examples of where property owners and managers do not follow Florida law and provide safe premises. Some examples of this are:
- A Naples woman who suffered a brain injury and broken hip in a fall occurring when she was knocked down by a broken door.
- An accident victim suffered a serious fracture of his foot when falling from a ladder while on the job.
- An elderly woman fell as a result of a defective staircase.
- A trip and fall accident victim suffered a broken knee as a result of tripping and falling on an improperly place bicycle rack outside a local grocery store.
As you see, slip and fall accidents can cause serious injury. It is important that the Slip and Fall Attorney Team investigate these accidents carefully. Trip and fall accidents can often be prevented by regular inspections and maintenance," says Slip and Fall Attorney Randall Spivey of Spivey Law Firm, Personal Injury Attorneys, P.A.
