When Trucks Fail to Yield to Motorcycles

FDOT analyzed 10 years of Florida motorcycle accidents and found that 60 percent of the time drivers of other vehicles, including cars, were at fault because they failed to yield the right of way.
Recent Florida Motorcycle/Truck Right-of-Way Accidents
In May 2023 alone, there were at least three Florida motorcycle/truck accidents where motorcyclists tragically died:
A 25-year-old Naples man tragically died in May 2023 when a pickup truck failed to yield and collided with his motorcycle, according to a Florida Highway Patrol (FHP) incident report. The crash happened along Old U.S.41 near Bonita Drive in Bonita Springs.
On May 2, 2023, a 57-year-old motorcyclist tragically died in a head-on crash with a garbage truck in Orange County, FL, according to FHP. The garbage truck was turning onto S.R. 436 when it struck the motorcycle.
In Volusia County, FL, a motorcyclist near a Volusia County middle school, tragically died in a crash with a pickup truck near the intersection of Enterprise Road and Jena Drive in Deltona on May 10, 2023.
Florida Right-of-Way Law
Florida law protects the rights of motorcyclists and all other drivers using the state’s roadways under Florida Statute 316.123 Vehicle entering stop or yield intersection which says:
The driver of a vehicle approaching a yield sign shall, in obedience to such sign, slow down to a speed reasonable for the existing conditions and, if required for safety to stop, shall stop before entering the crosswalk on the near side of the intersection, or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. After slowing or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another highway so closely as to constitute an immediate hazard during the time the driver is moving across or within the intersection.
