Woman Critically Injures Canadian Tourist in Hit and Run, Gets Released From Jail
June 2, 2015 | Category: Automobile Accidents | ShareAccidents occur on Florida roadways all the time. Some are more serious than others and can lead to any number of injuries ranging from minor scrapes to very serious head trauma or even death. Randall Spivey and the Ft. It is important to hold those who cause such accidents legally responsible for their actions. However, if an accident is caused by a driver who decides to flee the scene, it could become more difficult to bring that driver to justice without having skilled representation by your side.
Hit-and-run accidents occur more often than people realize. For instance, NBC Miami recently reported a hit-and-run incident that occurred in Miami in late March. According to the article, the 26-year-old female driver critically injured a 22-year-old man who was in town from Canada for the Ultra Music Fest.
The young man was looking for a cab after leaving a club around 5:30 a.m. when he was hit. The young woman fled the scene without providing assistance or aid as required by law. The young man sustained multiple injuries and was in critical condition at the time of the report.
Subsequently, the woman's vehicle was found in a parking lot and ultimately, she turned herself in. The article noted the driver did not have a Florida license, nor could she prove she had a license from any other state.
What You Need to Know About Hit-and-Run Accidents
Under Florida law, fleeing the scene of an accident is against the law, particularly when the crash involves property damage, bodily injury or death. Many have said that the laws pertaining to hit-and-run collisions tend to favor the driver as opposed to the injured. Florida Highway Patrol leaders have particularly made note that hit-and-runs are a huge problem in Florida.
In the incident discussed above, the driver came forward on her own; however, in many hit-and-run incidents, the driver remains unknown. Still, even if the driver is never located, an accident victim may still be able to obtain damages from his or her own insurance company, depending on whether or not the coverage carried includes uninsured or underinsured motorist coverage.
Such coverage protects those who have been involved in an accident with a driver who was uninsured or underinsured at the time of the incident, and it will also provide damages in the event of a hit and run.
The officers involved in the above-mentioned accident noted that had the driver stayed on the scene, she may have simply been issued a ticket; however, now she is facing more serious charges because of her decision to flee.
If she becomes subject to a civil injury lawsuit, the injured man will likely recover punitive damages, along with monetary amounts that will compensate him for the medical costs incurred, as well as lost wages, pain and suffering and more.
